Devant Privacy Notice

1. Who we are and scope

Devant is offered by Poe Technology Holdings, LLC (Poe Technology Holdings, we, us, or our). This Notice explains how we handle personal information when you use Devant or communicate with us about it.

This Notice does not replace the End User License Agreement or the privacy practices of third-party services you choose to use.

2. Information we collect

We collect information you provide, information generated while you use Devant, and limited information from service providers that help us operate Devant. The categories may include:

• Account and profile information, such as your name, email address, studio or organization, account identifier, and preferences.
• Authentication and security information, such as account events, MFA enrollment status, session and device-access information, installation or device identifiers, and EULA-acceptance records.
• Age-eligibility information, such as the country group, age-gate result, and date of birth when an age gate is enabled.
• Billing and entitlement information, such as subscription, trial, Alpha, or access status, invoice records, and payment-processor customer identifiers. Payment-card details are processed by a third-party payment processor, not stored by Devant.
• Alpha, support, recovery, and contact-request information, such as messages, submitted contact details, organization details, and troubleshooting information you choose to provide.
• Viewer service-use information, such as viewer name or identity, room membership and access events, device or browser details, IP address, user agent, rate-limit events, and diagnostics.
• Project and display information, such as project, playlist, track, cue, and playback metadata, and information included in a cloud projection or support package. Source audio normally remains local unless you choose a feature that transfers it.

3. How we use information

We use personal information to provide and secure accounts, authenticate users, enforce access and device limits, deliver the Backstage Viewer, process billing and entitlements, respond to requests, maintain and improve Devant, communicate about the service, prevent fraud or abuse, and comply with legal obligations.

4. Cloud Viewer and local use

When you use the cloud Backstage Viewer, Devant may transmit or store the room, access, participant, project, playlist, and display information needed to show the authorized audience what is playing and what is next. Room codes and optional PINs help control access; they are not a substitute for your own assessment of what information is appropriate to display.

If you use local viewer features, information may be available to devices on the network you configure. Operators should avoid placing sensitive, confidential, or restricted material in a room, projection, or package unless they have a lawful basis and appropriate authorization to do so.

5. How we disclose information

We disclose personal information only as needed to operate Devant, at your direction, to comply with law, protect people and the service, or support a corporate transaction. We do not sell personal information or share it for cross-context behavioral advertising.

• Service providers, including Supabase for application services, a third-party payment processor for payments, SMTP2GO for email delivery, and hosting or content-delivery providers such as AWS CloudFront.
• Other users at your direction, for example authorized participants in a Viewer room or recipients of a package you choose to share.
• Professional advisers, authorities, or transaction parties when reasonably necessary for legal, security, compliance, financing, merger, acquisition, or similar purposes.

6. Retention

We retain account and entitlement records for as long as the account is active and generally up to 12 months after access ends, subject to legal, tax, dispute, security, or backup requirements. Operational logs are generally retained for 6 to 12 months. Billing and tax records may be retained longer when required by law. Files kept only on your computer or local network remain under your control.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No service or transmission is completely secure. You are responsible for protecting your credentials, MFA factors, devices, room codes, PINs, and local project files.

8. Your privacy choices and rights

Depending on where you live, you may have rights to request access, correction, deletion, a copy of personal information, or to limit or object to certain processing. You may also have the right to appeal a decision about your request. To submit a request, email privacy@poetechholdings.com with the subject Devant Privacy Request. We may verify your identity before completing a request.

9. International processing

Devant and its service providers may process information in the United States and other countries that may have different data-protection laws than your place of residence.

10. Children

Devant is not directed to children under 13, and we do not knowingly collect personal information from them. Do not create an account if you do not meet the applicable minimum age shown during account creation. If you believe a child has provided personal information to us, contact us so we can address the issue.

11. Cookies and local storage

Our websites and services may use essential cookies, browser storage, and similar technologies to remember settings, maintain sessions, protect against abuse, and measure service operation. We do not use them for cross-context behavioral advertising.

12. Changes to this Notice

We may update this Notice from time to time. We will post the updated version with a new effective date and, where required, provide additional notice or obtain consent.
